ABSTRAK Dewan perwakilan daerah merupakan bagian dari Majelis Permusyawaratan Rakyat, dimana Dewan Perwakilan Daerah dapat mengajukan Rancangan Undang-Undang yang berkaitan dengan otonomi daerah, hubungan pusat dan daerah, pembentukan dan pemekaran serta penggabungan daerah,pengelolaan sumber daya alam dan sumber daya ekonomi lainnya,serta berkaitan dengan pertimbangan keuangan pusat dan daerah. Tetapi hasil pengawasannya tersebut diserahkan kepada Dewan perwakilan Rakyat. Penelitian ini bertujuan untuk mengetahui Bagaimana peranan Dewan Perwakilan Daerah dalam Pemekaran Daerah Kota Batu di Jawa Timur. Metode jenis penelitian yang digunkan dalam penelitian ini adalah penelitian Normatif, adapun pendekatan yang digunakan adalah pendekatan Konseptual dan pendekatan perundang-undangan. Dewan Perwakilan Daerah berdasarkan Pasal 22D ayat (1), (2), dan (3) Undang-undang Dasar Negara Kesatuan Republik Indonesia Tahun 1945 memiliki kedudukan yang sangat jelas, akan tetapi dalam menjalankan kewenangannya kedudukan DPD tidak fungsional dalam membahas RUU dan memberi petimbangan kepada DPR, DPD tidak sebagai pembentuk Undang-undang tetapi hanya sebagai lembaga yang mengajukan RUU. Sedangkan fungsi pengawasan DPD tidak ditindaklanjuti oleh DPD sendiri, tetapi di sampaikan kepada DPR, maka adanya ketidak seimbangan antara wewenang DPR dan DPD sehingga akan menimbulkan suatu ketidak maksimalan. Kata Kunci: Kewenangan,kedudukan, dan fungsi DPD dalam ketidak maksimalan antara wewenang DPR dan DPD yang diatur dalam UUD NRI Tahun 1945.

ABSRTACT Regional Representative Council is part of the People's Consultative Assembly, where the Regional Representative Council can propose Draft Laws relating to regional autonomy, central and regional relations, formation and expansion and merging of regions, management of natural resources and other economic resources, and related with central and regional financial considerations. But the results of his supervision were submitted to the People's Representative Council. This study aims to determine how the role of the Regional Representative Council in the Regional Development of Batu City in East Java. The type of research method used in this study is Normative research, while the approach used is the conceptual approach and the legislative approach. The Regional Representative Council based on Article 22D paragraphs (1), (2), and (3) of the 1945 Constitution of the Unitary State of the Republic of Indonesia has a very clear position, but in exercising its authority the position of the DPD is not functional in discussing the bill and giving consideration to the DPR, the DPD is not as a legislator but only as an institution that submits a bill. While the oversight function of the DPD is not followed up by the DPD itself, but is submitted to the DPR, then there is an imbalance between the authority of the DPR and the DPD so that it will cause an inadequacy.
