AbstrakrnWilayah perairan Indonesia memiliki potensi besar dalam industri pariwisata bahari yang dapat mendukungpengelolaan ekonomi yang pesat.Namun, tepatnya diPulau Maduramengalami kendala dalampengembanganterhadappengelolaan dan legalitaspemanfaatan ruang lautnya yang terdapat di pesisir-pesisir pantai tersebut, khususnya diPantai E KasoghiKabupaten Sumenep.Adapun yang dibahas mengenaikontruksi yuridis karakterpengelolaan sektor industripariwisata bahari, sertaaspek legalitas yang terpenuhi berdasarkan pengaturan subyek pemanfaatan ruang laut terhadap pelaku usaha pada sektor industri pariwisata bahariPantai E KasoghidiDesa Tanjung, Kecamatan Saronggi, Kabupaten Sumenep. Oleh karena itu,penelitian ini dilakukan untuk mengkajisubyek pemanfaatan ruang lautyangmengacu pada beberapa pengaturan, yaituUndang-Undang Nomor 6 Tahun 2023 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 Tentang Cipta Kerja Menjadi Undang-Undang, Peraturan Menteri Kelautan dan Perikanan Republik Indonesia Nomor 28 Tahun 2021 Tentang Penyelenggaraan Penataan Ruang Laut, dan sebagainya.Metodologi penelitian yang digunakan adalah penelitianhukumempirisdengan pendekatan fakta. Hasil dari penelitian inimenjelaskan bahwakontruksi yuridis karakter pengelolaan yang dilakukan didestinasiPantai E Kasoghimelalui peran Pemerintah Desa Tanjung dan PokmaswasReng Paseser.Kedua subyek tersebut belum memperhatikankepatuhan aspek legalitas pemanfaatan ruang laut,dikarenakanstatus hukum Pantai E Kasoghi masihmenggunakan dokumenLetter C.Pasal47A Ayat (2) huruf d UU 6/2023, besertaPasal 36dan Pasal 113Permen KKP 28/2021, Pantai E Kasoghi wajib memiliki izin KKPRL.Pasal 8 UU 6/2023 jo Pasal 12 PP 5/2021,subyek lainnya,pelaku usaha Poklahsar Raji Pandawa belum memenuhiaspek legalitasizin KKPRL,dikarenakan hanya menggunakan izin KKPR DaratmelaluiNomor Induk Berusaha (NIB) 2804220011059, Standar Nasional Indonesia (SNI),dan pernyataan jaminan halal.Pasal 10 PP21/2021,pelaku usaha tersebut belum memenuhi RTRW Provinsi, dikarenakanhasil buah mangrove yangdipetik dari pohonnyaberada di tepi Pantai E Kasoghihingga ke tengah laut.Hutan mangrove di perairan pesisirberada di antarasejauh 0 (nol)sampai12(dua belas)mil(Pasal 1 Ayat (14) Permen KKP 28/2021).rnKata Kunci:Pantai–Pengelolaan–Pemanfaatan Ruang Laut–Legalitas

AbstractrnIndonesian waters have great potential in the marine tourism industry that can support the management of a rapid economy. However, precisely in Madura Island, there are obstacles in the development of the management and legality of the utilization of marine space contained in the coasts, especially in E Kasoghi Beach, Sumenep District. As discussed about the juridical construction of the character of the management of the marine tourism industry sector, well the aspects of legality that are fulfilled based on the regulation of the subject of marine space utilization against business actors in the marine tourism industry sector on E Kasoghi Beach in Tanjung Village, Saronggi District, Sumenep Regency. Therefore, this research was conducted to study the subject of marine space utilization which refers to several regulations, namely Law Number 6 of 2023 concerning Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law, Regulation of the Minister of Maritime Affairs and Fisheries of the Republic of Indonesia Number 28 of 2021 concerning the Implementation of Marine Spatial Planning, etc. The research methodology used is empirical legal research with a factual approach. The results of this study explain that the juridical construction of the management character carried out at the E Kasoghi Beach destination is through the role of the Tanjung Village Government and Pokmaswas Reng Paseser. The two subjects have not paid attention to compliance with the legality aspects of marine space utilization, because the legal status of E Kasoghi Beach is still using a Letter C document. Article 47A Paragraph (2) letter d of Law 6/2023, along with Article 36 and Article 113 of KKP Minister 28/2021, E Kasoghi Beach is required to have a KKPRL permit. Article 8 of Law 6/2023 in conjunction with Article 12 of PP 5/2021, other subjects, Poklahsar Raji Pandawa business actors have not fulfilled the legal aspects of KKPRL licenses, because they only use Land KKPR licenses through the Business Identification Number (NIB) 2804220011059, Indonesian National Standards (SNI), and halal guarantee statements. Article 10 of PP21/2021, the business actors have not complied with the Provincial RTRW, because the mangrove fruit picked from the tree is on the edge of E Kasogh Beach to the middle of the sea. Mangrove forests in coastal waters are located between 0 (zero) to 12 (twelve) miles (Article 1 Paragraph (14) Permen KKP 28/2021).rnKeywords: Beach-Management-Marine Space Utilization-Legality
